Rental agreement
In Turkey there is normally no obligation to execute a rental agreement before a notary public. However, foreigners in Turkey usually need a notarized rental agreement in order to meet the requirements of the Immigration Office when applying for a residence permit. To prevent counterfeit documents, the authorities require a rental agreement between a foreign tenant and a landlord to be executed at a notary public.
The agreement itself may be in any language, but Turkish legislation does not allow notaries to authenticate a foreign-language document without its Turkish translation. Under these circumstances, either a sworn translator attends the execution of the rental agreement at the notary public for oral translation, or the rental agreement is translated by a sworn translator into the required language before the tenant and landlord execute it at the notary public. What you need, and what we do
- Both tenant and landlord must be present at the notary, each with an ID (foreigners: passport with notarized translation).
- The lease may be bilingual, but the notary authenticates only the Turkish text; we prepare or translate it beforehand.
- A sworn interpreter attends the signing for the foreign party.
- The notarized lease is the document accepted in residence permit (ikamet) applications.
- If the landlord cannot attend, the lease can be signed by their attorney-in-fact.
